O autor analisa os postulados do finalismo e retira suas consequências para a delimitação do conceito de dolo. Dentre essas consequências, defende que o reconhecimento do dolo eventual na estrutura finalista do delito acontece de forma incoerente, devido, sobretudo, aos postulados que fizeram do finalismo uma das teorias mais aceitas pela doutrina, a saber: o respeito às estruturas lógico-objetiva e a inclusão do dolo no tipo subjetivo.

Physiological responses in futsal have not been studied together with temporal information about the players’ stay on the court. The aim of this study was to compare heart rate and blood lactate concentration responses between 1-H and 2-H considering the time of permanency of the players on the court at each substitution in a futsal match. HR was recorded during entire match and [La−] was analyzed after each substitution of seven players. %HRmean and [La−] mean did not differ between 1-H (...) and 2-H. Time in intensity zones of 50–100 %HRmax differed only in 60–70 %HRmax. HR coefficient of variation throughout the match was low and among the four outfield players on the court. Substitutions, time of permanence on the court, ratio between time in- and out-ratio on the court also were similar between 1-H and 2-H. Balancing the number of substitutions, and the In:Outcourt ratio of players in both halves of the match, playing lower time at 1-H, ~8 min for each participation in the match, made it possible to maintain intensity of the match in 2-H similar to the 1H. These results are a good guidance to coaches and for application in future studies. (shrink)

Background: Clinical and experimental findings have suggested that insomnia is associated with altered emotion processing, such as facial emotion recognition and impairments in executive functions. However, the results still appear non-consensual and have recently been presented by a few number of studies. Accordingly, the aim of the present study was to investigate whether patients with Insomnia disorder will present alterations in recognition of facial emotions and that such alterations will be related to Executive Functions and that Insomnia Disorder patients will (...) exhibit a lower Executive Functions performance when compared to normal controls individuals. Method: A total of 11 individuals diagnosed with insomnia disorder and 15 control participants took part in the present cross-sectional study. They completed questionnaires covering socio-demographic data, a sleep and mood evaluation, and a cognitive assessment. Moreover, they underwent a computerized Facial Emotional Recognition test, consisting of facial emotion labeling and facial emotion matching. Results: Individuals with insomnia presented a lower recognition of facial expressions of fear and sadness in comparison to control volunteers. Perceptual Organization Index was found to be statistically significant lower in the insomnia group compared to the control group. There was a statistically significant association between facial recognition emotional and cognitive processes of in executive functions performance, especially in processes related to the inhibitory control, planning capacity, problem solving and cognitive flexibility in insomnia group. Conclusions: Insomnia disorder impairs the facial emotion recognition of the fear and sadness. Insomniacs with impairment in the facial emotion recognition had impaired performance of executive functions. There is a negative impact on processes related to cognitive-emotional capacity than on processes related to social-emotional recognition. ABSTRACT This article aims to analyze, from a Bakhtinian perspective, the grotesque construction of Mexican artist Frida Kahlo’s body through a religious worldview. Therefore, we analyze two of her self-portraits, taking into account the dialogic relations constructed between the grotesque representations and Catholic symbology. The analyzed utterances, in which the specificities of the creative competence of the author-creator in her aesthetic activity are inferred, showed that a dialogue is established between the painting El venado herido and Catholic Saint Sebastian and (...) between the painting Las dos fridas and the image of the Sacred Heart of Jesus. Tradicionalmente estudadas pela ciencia arqueológica que interpreta tais imagens com o rigor metodológico e as teorías que lhe embasam, neste trabalho propomos analisá-las como resultante de uma triangulação entre corpo, meio e ambiente, tendo como horizonte teórico a Antropología da Imagem, de Hans Belting, e a Teoria da Cultura, de Ivan Bystrina. Sadler suggests irrationality may be the key to distinguishing psychiatric from nonpsychiatric violence. We are not so sure that this is necessarily as helpful as it might at first seem. Who gets to decide what is rational? (...) Much “normal” violence, committed in the heat of the moment, impulsively, and drunkenly, may not appear that rational, even to the perpetrator, in the cold light of day. We are not sure one would wish to bring this sort of violence within the province of psychiatric explanations. Likewise, a point we made in our paper: Even delusionally driven violence often has its own internal coherence and rationality within an irrational framework.We found much to agree with in McCallum’s commentary, and perhaps his alternative approach is more helpful. He proposes a more sociological model of understanding what is going on in these complex cases, one that starts with societal dividing practices. Our present times have been described as the tyranny of the bureaucrats. Professional approaches are devalued. Diagnosis is only relevant in terms of its bureaucratic utility in moving people from one category to another. Since the writing of our paper, the criminal law has changed further in England and Wales. The Criminal Justice Act 2003 brought with it new sentences of indeterminate detention for public protection for those offenders categorized as “dangerous.” The presence or absence of psychiatric disorder being largely irrelevant for these purposes. This would seem to fit nicely with McCallum’s analysis, and in principle rather takes the wind out of our sails when we argued about the discrimination against psychiatric violence—now a diagnosis is not necessary for the state to intervene in a probabilistic fashion to prevent future violence. Deciding between what sort of violence counts as psychiatric and what does not, does not have quite the same drastic differential effect on the individual as perhaps it did. To provide rigour when preparing a research design, the researcher needs to carefully consider not only the methodology but also the philosophical intent of the study. This, however, is often absent from reported research and provides the reader with little evidence by which to judge the merits of the chosen methodology and its influence on the study. The purpose of this paper is to set out the case for critical realism as a framework to guide appropriate action in practice development (...) and realistic evaluation for understanding the consequences of those actions.It is evident that critical realism and critical social science share common ground. Emancipatory practice development (ePD) is based on the philosophy of critical social science and therefore by virtue is linked to the tenets of critical realism. Until now, the evaluation of ePD programme has been well served by 4th-generation evaluation. However, this paper outlines the need for a different approach to evaluation, one that is based on critical realism, that is concerned with emancipation, and that can be used in the ever-changing environment of clinical practice. Realistic evaluation not only links strongly to ePD programmes, but also serves as the basis for effective research questions that will test the outcomes of the research and inform the transferability of ePD mechanisms into differing contexts. I argue that the present (if not insuperable) lack of fixed standards in philosophy is associated with three barriers to philosophical progress, pertaining to intra-disciplinary siloing, sociological rather than philosophical determinants of philosophical attention, and the encouraging of bias.

This article investigates the existence of an original Brazilian legal culture. It parts from a critical examination of the key moments in the history of Brazil through the accounts of its most important scholars, such as Caio Prado Júnior, Darcy Ribeiro, Sérgio Buarque de Holanda, Wilson Martins, Oliveira Viana, Roberto Damatta, José Murilo de Carvalho, among others. It identifies in the Brazilian legal culture something one might call tradition of exception, which can be found in many of its most (...) prominent aspects, such as the persistent denial of any general or abstract regulatory standards, the uncritical introduction of foreign doctrines and legal patterns, the maintenance of aristocratic traditions in social life and the historical disregard of the Brazilian people as political subject. The article also offers a reflection on the problems and potentials of the current historic moment, in which for the first time Brazilians face the possibility of a genuine cultural emancipation. Although from a philosophical perspective, many reflections can be brought up about the theorizing process, in this essay, we aim to reflect on the importance of the alignment between ontology and epistemology. This is particularly relevant because deeper discussions about the philosophical roots that underlay the theorizing processes remain as a lack in organizational and management studies. To support our work, we adopted the epistemic-ontological alignment model as a conceptual tool and the Resource-Based View (RBV) and some of its questionings (...) as an example to carry out a reflection exercise about its epistemic-ontological alignment. RBV is a theory that plays a prominent role in management studies, especially in the strategy field. Nevertheless, discussions regarding RBV philosophical foundations are not common in the mainstream of strategic management. After our analysis, we advise that scholars care about the philosophical roots of their theoretical proposals to promote constructive dialogue in their research communities. This can avoid empty discussions and criticisms based on incongruous worldviews. Our reflections also suggest that future research should embrace the plurality of paradigms as a source of renewal and transcendence in the production of knowledge. A multi-paradigmatic movement towards more eclecticism in Administrative Science can help produce new and underexploited combinations of knowledge in the theorizing process. (shrink)

In particular, the text aims to shed some light on the relationship between collaborative memory and the other two topics in this title—group-level cognizing and individuals—beginning with (...) the relationship between collective intentionality and collaborative remembering, and concluding with some brief comments on the politics of collaborative remembering by drawing on recent work that has been undertaken with eugenics survivors in Canada. There is much to admire in this book. As a rigorous and systematic physics-oriented presentation of an austere empiricist fundamental metaphysics, it has no real rivals. The clarity with which the overall vision is presented will provide a valuable stalking-horse for those who would defend less austere approaches in the future. Esfeld and Deckert never shy away from the radical consequences of their approach, or try to disguise its revisionary nature. I also found several points of agreement with Esfeld and (...) Deckert’s metaphysical outlook. In particular, I thought their form of structural realism sophisticated and plausible and their application of it to contemporary physics salutary. Fundamental metaphysics would be a more respectable discipline if all of its exponents felt the need to show how their preferred ontology plays out in the context of real physics. These points of agreement noted, I will concentrate in these comments on points where I disagree with Esfeld and Deckert. From my perspective, the metaphysical project of the book is subject to two serious objections: firstly, it remains insufficiently naturalistic and overly a prioristic, and secondly, it drains much of the explanatory power out of fundamental physics. I think there is something to be said in a positive and constructive vein about collective intentionality in non-human animals. Doing so involves probing at the concept of collective intentionality fairly directly (Section 2), considering the various forms that collective intentionality might take (Section 3), showing some sensitivity to the history of appeals to that concept and its close relatives (Section 4), and raising some broader questions about the relationships between sociality, cognition, and institutions by discussing two different possible cases (...) of collective intentionality in non-human animals: that of the social insects (Section 5) and that of highly social mammals, such as canines (Section 6). If the discussion here is on track, then the widely shared perspective on collective intentionality exemplified by the work of Searle and Tomasello needs to be reconsidered. (shrink)

Within Ajzen's Planned Behavior Theory framework, this article tests a model to estimate the predictors of entrepreneurial intention in academic scientists working in Chile. We adapted into Spanish the entrepreneurship intention questionnaire. We tested the entrepreneurship intention model on a sample of 1,027 scientists leading research projects funded by the Chilean Scientific and Technological Development Fund, the country's primary scientific research grant. The results show strong empirical support for the entrepreneurship intention model proposed while highlighting some critical issues specific to (...) entrepreneurial intention in scientists. In particular, we found an indirect effect of perceived subjective social support on entrepreneurial intention, which is mediated by entrepreneurial attitude and perceived behavioral control toward entrepreneurship. These results suggest that policies orientated toward promoting academic entrepreneurship should include developing a healthy social environment toward it, meaning that entrepreneurial intention is not only an individual but an organizational challenge. These policies should analyze the social norms guiding the scientists' reference groups to increase their effectiveness. (shrink)

In his account of visual perception, Thomas Reid describes visible figure as both ‘real and external’ to the eye and as the ‘immediate object of sight’. These claims appear to conflict with Reid's direct realism, since if the ‘immediate’ object of vision is also its direct object, then sight would be perceptually indirect due to the role of visible figure as a perceptual intermediary. I argue that this apparent threat to Reid's direct realism may be resolved by understanding visible figure (...) as the set of geometrical properties that holds between an object's visible surfaces and some particular perspective or point of view. On this relational interpretation of visible figure, and once an ambiguity over the use of the term ‘object’ is resolved, Reid's account of vision is both epistemically and perceptually direct, as well as consistent with his account of the other senses and doctrine of signs. Ecological weed management (EWM) is a scientifically established management approach that uses ecological patterns to reduce weed seedbanks. Such an approach can save organic farmers time and labor costs and reduce the need for repeated cultivation practices that may pose risks to soil and water quality. However, adoption of effective EWM in the organic farm community is perceived to be poor. In addition, communication and collaboration between the scientific community, extension services, and the organic farming community in the US is (...) historically weak. In order to uncover the most persistent obstacles to promoting effective weed management in organic agroecosystems, we use the mental models approach to generate an expert model based on interviews with experts (e.g., weed scientists, weed ecologists, and extension personnel) and theories from the behavioral sciences. The expert model provides two main insights: (1) EWM is a complex strategy that may cause farmers to use heuristics in management decisions and (2) the long-term benefits of EWM, rather than the risks, need to be emphasized in communication with and outreach to organic farmers. The basis for new research topics and outreach material that incorporates these insights from the expert model are discussed. We briefly explain how the expert model is an incomplete picture of on-farm practices, but provides the basis for the second step of our mental models research, the farmer interviews and farmer decision model development. This paper reflects on the relationship between theory and practice in bioethics, by using various concepts drawn from debates on innovation in healthcare research—in particular debates around how best to connect up blue skies ‘basic’ research with practical innovations that can improve human lives. It argues that it is a mistake to assume that the most difficult and important questions in bioethics are the most abstract ones, and also a mistake to assume that getting clear about abstract cases will automatically (...) be of much help in getting clear about more complex cases. It replaces this implicitly linear model with a more complex one that draws on the idea of translational research in healthcare. On the translational model, there is a continuum of cases from the most simple and abstract to the most concrete and complex. Insights need to travel in both directions along this continuum—from the more abstract to the more concrete and from the more concrete to the more abstract. The paper maps out some difficulties in moving from simpler to more complex cases, and in doing so makes recommendations about the future of bioethics. (shrink)

When a business owner approaches a bank for a loan for their business they might hope that a well-established bureaucratic procedure would ensure that their application was processed with stipulated rules and impersonal criteria. They might expect that two bank officials, evaluating the same proposal for a loan, would reach the same decision. However, research shows that both quantifiable data and “gut feelings” are used in the decision. In this research, analysis of interviews with senior managers, and both individual and (...) focus group interviews with bank loan officers, reveals that there are no set criteria or stipulated rules. The interviews demonstrate how and why nonquantifiable data is used, and why different bank officials can reach different conclusions on the same loan proposal. While these bank loan officers do not appear to be discriminatory against female business owners, the lending criteria and process allows significant room for discrimination. It appears questionable whether bank lending is seen as an ethical and fair process. (shrink)

This essay seeks to contribute to current debates about value in Kant's ethics. Its main objective is to dislodge the widely shared intuition that his view of autonomy requires constructivism or some other alternative to moral realism. I argue the following. Kant seems to think that the value of persons is due to their very nature, not to what anyone decides is the case (however rational or pure those decisions may be). He also seems to think that when we treat (...) persons as ends in themselves we are responding appropriately to the fact that their very nature elevates them above all other concerns. Neither of these beliefs is incompatible with his view of autonomy. So it is a mistake to think that Kant's ethics requires constructivism or any other form of anti-realism. (shrink)
